DEVELOPMENT CONTRACT <br />AGREEMENT, dated June , 2001, by and between the CITY OF LITTLE <br />CANADA, a Minnesota municipal corporation, ( "City ") and Thomas Theis and <br />Annette Theis, husband and wife ( "Developers "). <br />1. Request for Improvement. The Developers have requested the City <br />to allow the construction of sanitary sewer, storm sewer, with retention <br />ponding, water main, curb and gutter, bituminous streets, signage, and <br />lighting necessary to serve and provide access to the simple subdivision, <br />which is an extension of Leeward Way within the City of Little Canada, as <br />shown on Exhibit "A ". These public improvements will serve Parcels 1 and 2 <br />of the proposed subdivision of the following described property: <br />The south 85.72 feet of the north 1314.54 feet of Lot 13, Auditor's <br />Subdivision No. 43, County of Ramsey, State of Minnesota. <br />The improvement is necessary to provide access and utilities to the <br />proposed residential subdivision as shown on Exhibit "A ". <br />2. Conditions of Approval. The City hereby approves construction of <br />necessary extensions of sanitary sewer, storm sewer, with retention <br />ponding, water main, curb and gutter, bituminous streets, signage, and <br />lighting to serve the subdivision as shown on Exhibit "A ", conditioned upon <br />the Developers entering into this Agreement and guaranteeing compliance <br />with terms of this Agreement. <br />3. Compliance with Laws and Regulations. The Developers represent <br />to the City that to the best of their knowledge the construction of <br />improvements to serve the proposed subdivision as shown on Exhibit "A" will <br />comply with all City, County, Metropolitan, State and Federal laws and <br />Page 101 <br />
