regulations, including, but not limited to, subdivision ordinances, zoning <br />ordinances, noise ordinances, burying of all utilities and environmental <br />regulations; including wetland impact and mitigation. The Developers shall <br />obtain all necessary permits and consents for the project including, but <br />not limited to, the permit required by the Minnesota Department of Health <br />due to the water main extension, any necessary permits required from the <br />Minnesota Pollution Control Agency for sanitary sewer main extension, any <br />necessary approvals from Metropolitan Council - Wastewater Services Division <br />for connections to sanitary sewer lines, any permit required from the <br />Ramsey - Washington Watershed District for grading and storm water discharge, <br />and any permits or approvals necessary to comply with wetland regulations. <br />The Developers shall reimburse the City for any costs or expenses incurred <br />by the City due to the need for any permits or consents, and shall be <br />responsible for compliance with any other requirements imposed by the <br />agencies in question. <br />4. Development Exhibits. The Developers shall develop the proposed <br />plat in accordance with Exhibit "A ", attached hereto, and on file in the <br />offices of the City; and in accordance with City Council Resolution <br />No. 2001 -2 -48 adopted on February 28, 2001. <br />5. Required Improvements. The Developers shall install, at their <br />own expense, the extension of public improvements consisting of water main, <br />sanitary sewer main, storm sewer, concrete curb and gutter, the first lift <br />of the bituminous roadway, signage, and lighting, with all public <br />improvements to be completed no later than October 1, 2001. Any lighting <br />which may become an ongoing City expense shall be coordinated with the City <br />and Excel Energy to minimize future operational costs with Developers to <br />bear system installation costs to allow City to attain Excel Energy's <br />Page 102 <br />
