Any new buildings with sumps for which a building permit is issued after June 1, <br />1998, shall have a pump and shall be piped to the outside of the dwelling before a <br />certificate of occupancy is issued. <br />J. Violation of this Section is a misdemeanor and each day that the violation continues <br />is a separately prosecutable offense. The imposition of the surcharge shall not limit <br />the City's authority to prosecute the criminal violations, seek an injunction in District <br />Court ordering the person to disconnect the nonconforming connection to the sanitary <br />sewer, or for the City to correct the violation and certify the costs of connection as <br />an assessment against the property on which the connection was made. <br />205.090. TAMPERING WITH MUNICIPAL SEWER SYSTEM PROHIBITED. No person <br />shall maliciously, willfully or negligently break, damage, destroy, uncover, deface or tamper with <br />any structure, appurtenance or equipment which is a part of the municipal sewer system. No person <br />shall attach any prohibited or unreported lead or line to that system without having a permit to do <br />so, nor shall any unreported connection be made on the owners premises, inside or outside of the <br />building thereon, which would introduce waters or substances prohibited or forbidden by this Code. <br />205.100. CERTAIN CONNECTIONS PROHIBITED. No buildings located on property <br />lying outside the limits of the City shall be connected to the municipal sanitary sewer system unless <br />express authorization therefore is obtained from the Council of the City and the Council of the City <br />of St. Paul. <br />205.110. ENTRY UPON PRIVATE PROPERTY. The City Engineer Public Works <br />Director and other duly authorized employees of the City, bearing proper credentials and <br />identification, shall at reasonable times be permitted to enter upon all properties for the purpose of <br />inspection, observation, measurement, sampling and testing in connection with the operation of the <br />municipal sanitary sewer system. <br />205.120. REPAIR OF PUBLIC RIGHT OF WAY AND GAS LINES. <br />(1) No connection to the municipal sanitary sewer system shall be finally approved until <br />all streets, pavements, curbs and boulevards or other public improvements thereon have been <br />restored to their former condition to the satisfaction of the City Engineer Public Works Director. <br />(2) Whenever any licensee hereunder or any other person engaged in making a <br />connection to the municipal sanitary sewer system shall damage the coating on any gas mains or gas <br />lines, such damage shall be promptly reported by the person causing such damage to the Northern <br />States Power Company or its successors before such gas line or gas main is covered with earth. <br />Failure to make such report shall be considered a violation of this Code subject to penalties herein <br />PAGE 100 <br />
