The Plumbing Inspector Public Works Director may permit <br />variations from the strict application of any of the provisions of this Code if he is satisfied that there <br />are special circumstances or conditions affecting the premises for which the variance is requested <br />and that the granting of such variance will not materially adversely affect the public health, safety <br />or general welfare or public or private property. Any variation permitted under this provision must <br />be noted on the permit. <br />205.140. SEWER RATES AND COLLECTION OF CHARGES. <br />(A) There shall be a quarterly charge for use of the municipal sanitary sewer system. This <br />quarterly charge and the penalty in (E) below shall be set forth and are subject to change by <br />resolution of the City Council of Little Canada and shall at all times be subject to provisions of <br />pertinent contracts with the Metropolitan Council Environmental Services. <br />(8) All accounts shall be kept by the street number and under the account number <br />assigned thereto, and by the name of the owner. All bills and notices shall be sent to the owner's <br />address. If a non - residing owner desires bills and notices be sent to a different address, they shall <br />notify the Utility Billing Department. If the property owner has requested bills and notices be sent <br />to the property's tenant, and should a tenant be delinquent in payment of account balances, the <br />property owner shall be ultimately responsible for payment of the sewer charges. <br />(C) Where sery ice is for less than a quarterly period, the quarterly charges will be pro- <br />rated on a monthly basis. <br />(D) Where an automatic sprinkler or irrigation system is connected to the Municipal <br />water supply and metered separately, there shall be no sewer charged in association with that water <br />usage. <br />(E) Rates due and payable by each sewer user located beyond the territorial boundaries <br />of the City shall be determined by a special contract. <br />(F) Statements for sewer charges for the preceding quarterly period shall be mailed to <br />each customer on or before the 15 `11 day of January, April, July, and October of each year. Any <br />account which remains unpaid thirty (30) or more days after the bill is mailed is a delinquent <br />account. A penalty in the amount of ten percent (10 %) of the unpaid balance shall be added to each <br />delinquent account. Any pre - payment or overpayment of charges may be retained by the City and <br />applied on subsequent quarterly statements. <br />(G) Once annually, notice shall be provided to all account holders and owners with a <br />delinquent balance notifying them of the delinquency.
