as shown adjacent to the BN property. <br />Summary and Recommendation <br />The property in question is adjacent to the Burlington Northern railroad, and is <br />encumbered by the St. Paul Waterworks easement on a significant portion. The proposed <br />five foot setback is the same as what was granted to adjacent property owners, based on <br />the shallowness of those properties. Under these conditions, and with staff confirmation <br />that terms of the existing Conditional Use Permit have been complied with, the variance <br />for a five foot setback for an accessory storage building is recommended for approval. <br />The minimum building separation between existing and proposed building, however, is six <br />feet.
