NMC <br />MEMORANDUM <br />NORTHWEST ASSOCIATED CONSULTANTS <br />COMMUNITY PLANNING - DESIGN' - MARKET RESEARCH <br />TO: Little Canada Planning Commission <br />FROM: Stephen Grittman <br />DATE: July 10, 2000' <br />RE: Little Canada - Valenta Setback Variance <br />FILE NO: 758.09 - 00.20 <br />Background /Analysis <br />Don Valento has applied for a variance to the side yard setback requirements for a.parcel <br />in Ryan Industrial Park at 3179 Spruce Street. The site is zoned 1 -1,. Light Industrial. The <br />site is developed with an industrial building, and abuts the Burlington Northern Railroad <br />on the north and the St. Paul Waterworks on the west. <br />The applicant would like to construct a 40 foot by 26 foot accessory building for use as a <br />storage area for the existing building tenants. Two semi - trailers which were previously <br />used for storage were required to be removed from the property by previous Council <br />action. Due to the configuration of the site, the applicant is requesting a reduction of the <br />setback requirement on his northerly side yard from fifteen feet to five feet. <br />The configuration of property along the BN railroad has been the. basis for two setback <br />variances on adjacent land. Both the Belland auto repair facility and the Stanke industrial <br />building were granted a five foot setback from the railroad, both rear yards. The applicant <br />in this case has stated that the waterworks easement restricts him from constructing the <br />building to the rear of the lot where it might otherwise meet the setback requirements, and <br />the additional covered storage area is necessary. <br />The Zoning Ordinance states that configuration of an existing parcel is one of the possible <br />criteria for variance consideration. Moreover, it states that the City must not deny a <br />variance for rights which are commonly enjoyed by other properties in the same zoning <br />district.
