N N C <br />MEMORANDUM <br />NORTHWEST ASSOCIATED CONSULTANTS <br />COMMUNITY PLANNING - DESIGN - MARKET RESEARCH <br />TO: Little Canada Planning Commission <br />FROM: Stephen Grittman <br />DATE: August:7, 2000 <br />RE: Little Canada - Valento Accessory Building Variance <br />FILE NO: 758.09 - 00.17 <br />The Planning Commission reviewed the request of Don Valento for a setback variance <br />from the 15 foot side yard along the Burlington Northern railroad property at its previous <br />meeting. The City Council tabled action on that variance out of a concern that the <br />variance was intended primarily to avoid the requirements for fire suppression sprinkling. <br />It was the Council's position that a variance should not be approved if its primary purpose <br />was to avoid the City's sprinkling requirements. Mr. Valento stated that the existing <br />building could not be sprinkled due to its construction. The Council directed staff to follow <br />up on this issue, as well as the applicant's concerns over the use of the Water Works <br />easement to the rear of the parcel. The Water Works easement was cited as a major <br />reason for placing the building in the side yard. <br />At the Council - meeting, it was determined that the. City's regulations which prohibit <br />accessory buildings in the side yards also apply to industrial properties, and Mr. Valento's <br />proposed location would violate this clause. Therefore, a variance from this issue is now <br />also requested. The City Council is expected to act on the original variance request at its <br />August 9 meeting_ <br />The City's industrial district regulations include an accessory building of up to 30% of the <br />floor area of the principal building as a permitted accessory use of property. It was staffs <br />position that the proposed building, at 26% of the size of the principal building, was a <br />permitted building. The applicant's description of the traffic flow on the site appeared to <br />support the concern that the building, otherwise permitted, could not be constructed within <br />the normal setbacks.
