NC <br />MEMORANDUM <br />NORTHWEST ASSOCIATED CONSULTANTS <br />COMMUNITY PLANNING - DESIGN - MARKET RESEARCH <br />TO: Little Canada Planning Commission <br />FROM: Stephen Grittman <br />DATE: August 3, 2000 <br />RE: Little Canada - Tacheny Garage CUPIVariance <br />FILE NO: 758.09 - 00.19 <br />BACKGROUND <br />In response to staff comments regarding the Tacheny accessory building location, the <br />applicants requested that the Conditional Use Permitbe tabled at the July meeting to allow <br />the opportunity to apply for a setback variance. The CUP is now being proposed with a <br />variance request to allow the setback of 10 feet from the private street, rather than the 30 <br />feet front yard setback stated in the Zoning. Ordinance. <br />As noted in the July 10, 2000 staff report, CUPs for second and oversized garages are <br />typically reviewed as to their ability to fit on the lot and into the context of the <br />neighborhood. As such, the request for a setback variance to accommodate the additional <br />garage a raises question about the appropriateness of the CUP request. <br />ANALYSIS <br />Variances are reviewed against specific criteria in the Zoning Ordinance which are <br />designed to analyze whether or not there is a unique physical condition which creates a <br />hardship in putting the property to a reasonable use. Physical hardships often include <br />such conditions as narrow lots of record, unusual topography or other condition of the <br />land.
