MINUTES <br />CITY COUNCIL <br />OCTOBER 27, 1999 <br />RESOLUTION NO. 99 -10 -201 — APPROVING THE VARIANCE <br />FROM THE REAR YARD SETBACK REQUIREMENT OF TWENTY <br />(20) FEET ALLOWING A FIVE (5) FOOT REAR YARD SETBACK <br />FOR BUILDING ADDITION AT 209 RYAN DRIVE AS REQUESTED <br />BY ROGER STANKE SUBJECT TO COMPLIANCE WITH THE <br />RECOMMENDATIONS OF THE PLANNING COMMISSION AND <br />THE CITY PLANNER AND FINDING THAT A HARDSHIP EXISTS <br />DUE TO THE FACT THAT THIS IS LOT OF RECORD WHICH IS <br />EXTRAORDINARILY SHALLOW <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Morelan, LaValle, Pedersen, Scalze, Fahey. <br />Nays (0). Resolution declared adopted. <br />FINAL PLAT, The Council reviewed the Final Plat, Final PUD, and conducted the <br />FINAL PUD, architectural review for the Blacktern Office Park noting the <br />ARCHITECTURAL recommendations of the City Planner, City Engineer, Public Works <br />REVIEW — Director, and City staff. <br />BLACKTERN <br />OFFICE PARK There was no one present from the public wishing to comment on this plat. <br />David Ficek, DaVern Construction, reported that he will also be granting a <br />four foot utility easement on the front of the lots as requested by the City. <br />Ficek reported that he has reviewed the recommendations relative to the <br />plat and will comply with them. <br />Morelan pointed out the City Engineer's recommendation that a public <br />easement be provided for the storm sewer, but that the development <br />agreement address the fact that the property association will be required to <br />operate and maintain storm sewer. The City Administrator suggested that <br />a covenant be placed on the property addressing this issue. <br />The City Planner reported that building, landscaping, and signage plans <br />meet the City's architectural requirements. <br />Mrs. Scalze introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 99 -10 -202 — APPROVING THE FINAL PLAT, <br />FINAL PUD, AND THE ARCHITECTURAL REVIEW FOR THE <br />BLACKTERN OFFICE PARK BASED ON COMPLIANCE WITH <br />THE RECOMMENDATIONS OF THE CITY PLANNER, CITY <br />ENGINEER, PLANNING COMMISSION, AND CITY STAFF <br />INCLUDING THE FACT THAT A STORM SEWER EASEMENT <br />SHOULD BE SHOWN ON THE PLAT AND THE DEVELOPMENT <br />Page 9 <br />
