The City <br />Administrator po" ted out that the, ounty section map does not reflect this <br />vacation. <br />It was the consensus of, ' Council that if Day Avenue has not been <br />vacated, it should be <br />Mr. Morelan i tcOduced the follow( g resolution and moved its adoption: <br />N. <br />RESOL ION NO. 99 -10 -200 — APPROVING THE CONDITIONAL <br />USE RMIT FOR GARAGE SPACE UflO 1,472 SQUARE FEET <br />A QUESTED BY MARK GRACZYK FOO WEST DEMONT <br />VENUE SUBJECT TO COMPLIANCE WITI$7 -IE <br />RECOMMENDATIONS OF THE PLANNING CdMMISSION AND <br />THE CITY PLANNER AS OUTLINED IN HIS REPORT DATED <br />OCTOBER 12, 1999 WHICH INCLUDES THE V4CA2"/?tY OF <br />ALLEYWAY AS WELL AS SUBJECT TO THE VACATION <br />aOF DAY <br />AVENUE <br />The foregoing resolution was duly seconded by LaValle. <br />Ayes (5) Fahey, Morelan, LaValle, Scalze, Pedersen. <br />Nays (0). Resolution declared adopted. <br />Fahey opened the public hearing to consider an application for a Variance <br />from the rear yard setback requirement of twenty (20) feet allowing a five <br />(5) foot rear yard setback for 209 Ryan Drive as requested by Roger <br />Stanke. Fahey noted that the Planning Commission and the City Planner <br />have recommended approval of the Variance. <br />There was no one present from the public wishing to comment on this <br />matter. <br />Upon motion by Morelan, seconded by LaValle, the public hearing was <br />ciosed. <br />Mr. Morelan introduced the following resolution and moved its adoption: <br />Page 8 <br />
