b. Special conditions and circumstances may not be primarily economic in <br />nature. <br />In this instance, there are special conditions or circumstances that exist that are <br />unique to the subject site. The property is triangular in shape and very narrow, <br />which severely limits the buildability of the site. As shown on the attached site plan, <br />there is only a small area of land that is buildable. <br />2. Literal interpretation of the provisions of this Ordinance would deprive the applicant <br />of rights commonly enjoyed by other properties in the same district under the terms <br />of this Ordinance. <br />If the literal interpretation of the City Code were upheld (and all of the required <br />setbacks satisfied), approximately 75 percent of the property would be rendered <br />unbuildable. Therefore, it is reasonable to allow some sort of variance in this <br />instance. <br />3. The special conditions and circumstances do not result from the actions of the <br />applicant. <br />The special conditions and circumstances (shape of the lot) are due to the location <br />of the rail line to the north and Ryan Drive, and are not a result of any actions by <br />the applicant. <br />4. Granting the variance requested will not confer on the applicant any special privilege <br />that is denied by this Ordinance to other lands, structures, or buildings in the same <br />district. <br />The granting of a variance on this site will not confer any special privilege to the <br />applicant. The size and shape of this site is unique to the 1 -1 Zoning District. The <br />adjacent property to the east is similar in size and shape, however, it is zoned PUD, <br />Planned Unit Development. <br />5. A genuine hardship exists in complying with the literal terms of this Ordinance. <br />The hardship in this instance is the narrow triangular shape of the lot, which makes <br />development of the majority of the site impossible. without the granting of a <br />variance. <br />Parking /Surfacing. According to the submitted site plan, the area south of the proposed <br />building addition is to be surfaced in concrete and asphalt. No changes to the existing <br />parking area access points have been proposed. A condition of variance approval, <br />specific off- street parking stalls should be identified upon the submitted site plan. As a <br />condition of variance approval, compliance with the City's off - street parking requirements <br />must also be demonstrated. <br />Page 5 <br />
