LITTLE CANADA <br />WHEREAS, the project has been submitted to the Minnesota Department of <br />Transportation to determine the eligibility for State Aid funding of the storm sewer items. <br />NOW, THEREFORE, IT IS HEREBY MUTUALLY AGREED AS FOLLOWS: <br />1. The City shall prepare the necessary plans, specifications and proposals in accordance <br />with the approved feasibility study. Costs of revisions to project items previously approved in <br />the feasibility study will be paid for by the party requesting the revisions. <br />2. The City shall take bids, and with concurrence of the County, award a contract for <br />construction of this subject project; the City shall perform the construction inspection; the City <br />shall perform the inspection of City utilities. <br />3. The County and City shall participate in the costs of construction in accordance with the <br />attached Ramsey County Public Works cost Participation Policy, dated 4 -1 -97, except as <br />provided in item 5. below or modified by the attached Estimated Cost Participation Summary. <br />V The County shall participate in items of work necessary for the relocation of electrical <br />service lines in an amount not to exceed $193,643. Only items of work eligible for State Aid <br />funding shall be considered. <br />5. The County and City shall participate in the costs of storm sewer construction to the <br />extent identified by the MD/DOT Hydraulics Engineer's Memorandum on storm sewer cost <br />participation percentages. <br />F. Any utilities or facilities modified or added to those provisions made in the plans and <br />specifications may be incorporated in the construction contract by supplemental agreement and <br />shall be paid for as specified in the supplemental agreement. Design engineering and <br />construction engineering fees shall be negotiated. <br />'7 The County shall reimburse the City for actual engineering costs incurred on its share of <br />project design and administration as a design engineering fee. The County share shall be <br />identified in partial cost estimates prepared by the City up to the time of contract award. In no <br />event shall the design engineering cost borne by the County exceed 10% of its share of costs as <br />determined at the time of contract award. The City shall furnish the County with an estimated <br />scope of services that sets forth all anticipated design engineering costs and respective City and <br />County shares, The County share of engineering costs shall not exceed this amount without <br />written authorization from the County. <br />b'. The County shall reimburse the City for construction engineering costs for its share of <br />construction costs as identified for each partial payment estimate up to and including final <br />payment. The total construction engineering fee borne by the County shall not exceed 12% of its <br />share of the construction costs as determined by final contract amounts. <br />Page 51 <br />L:1006 <br />
