If the business is not relocated, code enforcement action <br />would be taken. <br />Bixby indicated that six months should be adequate time for him to <br />relocate his business. <br />There was no one present from the general public wishing to comment on <br />this matter. <br />Upon motion by Morelan, seconded by Scalze, the public hearing was <br />closed. <br />Mr. Morelan introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2000 -4 -99 — APPROVING A SPECIAL USE <br />PERMIT TO ALLOWA HOME OCCUPATION CONSISTING OFA <br />SATELLITE AND ANTENNA INSTALLATION /SERVICE/REPAIR <br />COMPANY AT 2622 JACKSON STREET AS REQUESTED BY <br />SCOTT BIXBY FOR A PERIOD OF TIME NOT TO EXCEED SIX <br />MONTHS (NOVEMBER 1, 2000) WITH NO OPPORTUNITY FOR <br />RENEWAL OF THE PERMIT SUBJECT TO COMPLIANCE WITH <br />THE RECOMMENDATIONS OF THE CITY PLANNER AND THE <br />PLANNING COMMISSION <br />The foregoing resolution was duly seconded by Pedersen. <br />Ayes (4) Morelan, Pedersen, Fahey, LaValle. <br />Nays (1) Scalze. <br />PROPERTY Mayor Fahey opened the continued Public Hearing regarding the division <br />DIVISION — of 3240 Twin Lake Road into three single- family lots as requested by <br />3240 TWIN Preferred Builders. Fahey noted that the Planning Commission has <br />LAKE ROAD — recommended approval of the property division.. <br />MITCHELL <br />PROPERTY Morelan noted that the cul -de -sac easement at the end of Mitchell Trail is <br />proposed at a 45 -foot radius while the standard is 50 feet. Morelan asked <br />why not the standard 50 feet. <br />The City Planner pointed out that initially concepts were reviewed to <br />subdivide this property into four and five lots. The proposal before the <br />Council is for three lots, all of which will access Twin Lake Road or Twin <br />Lake Trail and not Mitchell Trail. Should the property ever be subdivided <br />again in the future and Mitchell Trail improved, it is likely that only two <br />lots would use Mitchell Trail for access. Therefore, it was felt that the <br />radius for the cul -de -sac would be adequate at 45 feet. <br />Page 4 <br />
