MINUTES City Council april 26, 1989 Scalze pointed out the City's recent purchase of 34 acres of park land, and the feeling of some people that the property should not have been taken out of development. Scalze pointed out that there are people on both sides of the issue. Fahey pointed out that the property owner has been paying taxes on this property, and has a right to develop it. Ms. Warner, Sylvan Street resident, reported that her back yard would abutt this residential development, and requested that as many trees as possible be saved. Fahey felt that many trees would be retained, pointing out that only the street area would likely be bulldozed. Boosalis agreed that as many trees as possible will be retained. Mr. Blesener introduced the following resolution and moved its adoption: RESOLUTION NO. 89 -4 -158 - CLOSING THE PUBLIC HEARING ON THE BOOSALIS DEVELOPMENT PROPOSAL The foregoing resolution was duly seconded by Mr. Collova. Ayes (5) Blesener, Collova, Fahey, Scalze, LaValle. Nays (0). Resolution declared adopted. Mr. Fahey introduced the following resolution and moved its adoption: RESOLUTION NO. 89 -4 -159 - APPROVING THE PRELIMINARY PLAT AND DEVELOPMENT PROPOSAL PRESENTED BY THE NICK BOOSALIS /ROI ENTERPRISE AS PRESENTED TONIGHT AND AS MODIFIED AND DISCUSSED WITH 16 RESIDENTIAL LOTS AND SUBJECT TO ANY ADDITIONAL REOUIREMENTS OF THE CITY PLANNER AFTER FURTHER REVIEW, AND SUBJECT TO SUBMISSION OF APPROPRIATE DRAINAGE PLANS TO BE REVIEWED AND APPROVED BY THE CITY ENGINEER AND WATERSHED ADDRESSING THE CONCERNS RAISED BY NEIGHBORS, AND SUBJECT TO PAYMENT OF APPROPRIATE PARK CHARGES, AND SUBJECT TO THE DEVELOPER ENTERING INTO A DEVELOPMENT AGREEMENT WITH THE CITY The foregoing resolution was duly seconded by Mr. Collova.
