MINUTES <br />City Council <br />april 26, 1989 <br />Scalze pointed out the City's recent purchase of 34 acres of park land, and <br />the feeling of some people that the property should not have been taken out <br />of development. Scalze pointed out that there are people on both sides of <br />the issue. <br />Fahey pointed out that the property owner has been paying taxes on this property, <br />and has a right to develop it. <br />Ms. Warner, Sylvan Street resident, reported that her back yard would abutt <br />this residential development, and requested that as many trees as possible <br />be saved. <br />Fahey felt that many trees would be retained, pointing out that only the <br />street area would likely be bulldozed. <br />Boosalis agreed that as many trees as possible will be retained. <br />Mr. Blesener introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 89 -4 -158 - CLOSING THE PUBLIC HEARING <br />ON THE BOOSALIS DEVELOPMENT PROPOSAL <br />The foregoing resolution was duly seconded by Mr. Collova. <br />Ayes (5) Blesener, Collova, Fahey, Scalze, LaValle. <br />Nays (0). <br />Resolution declared adopted. <br />Mr. Fahey introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 89 -4 -159 - APPROVING THE PRELIMINARY <br />PLAT AND DEVELOPMENT PROPOSAL PRESENTED BY THE NICK <br />BOOSALIS /ROI ENTERPRISE AS PRESENTED TONIGHT AND AS <br />MODIFIED AND DISCUSSED WITH 16 RESIDENTIAL LOTS AND <br />SUBJECT TO ANY ADDITIONAL REOUIREMENTS OF THE CITY <br />PLANNER AFTER FURTHER REVIEW, AND SUBJECT TO SUBMISSION <br />OF APPROPRIATE DRAINAGE PLANS TO BE REVIEWED AND APPROVED <br />BY THE CITY ENGINEER AND WATERSHED ADDRESSING THE CONCERNS <br />RAISED BY NEIGHBORS, AND SUBJECT TO PAYMENT OF APPROPRIATE <br />PARK CHARGES, AND SUBJECT TO THE DEVELOPER ENTERING INTO <br />A DEVELOPMENT AGREEMENT WITH THE CITY <br />The foregoing resolution was duly seconded by Mr. Collova. <br />Ayes (5) Fahey, Collova, Scalze, LaValle, Blesener. <br />Nays (0). <br />Resolution declared adopted. <br />Page 153 <br />
