DEVELOPMENT CONTRACT <br />AGREEMENT, dated April , 2000, by and between the CITY OF LITTLE <br />CANADA, a Minnesota municipal corporation, ( "City ") and Masterpiece Homes, <br />Inc., a Minnesota Corporation ( "Developer "). <br />1. Request for Improvement. The Developer has requested the City to <br />allow the construction of sanitary sewer, storm sewer, with retention <br />ponding, water main, curb and gutter, bituminous streets, signage, and <br />lighting necessary to serve and provide access to the proposed plat of Park <br />Place, within the City of Little Canada to serve the following described <br />property, as shown on Exhibit "A ": <br />Lots 1 -23, Block 1, of Park Place, County of Ramsey, State of <br />Minnesota. <br />2. Conditions of Approval. The City hereby approves construction of <br />necessary extensions of sanitary sewer, storm sewer, with retention <br />ponding, water main, curb and gutter, bituminous streets, signage, and <br />lighting to serve the Park Place plat, conditioned upon the Developer <br />entering into this Agreement and guaranteeing compliance with terms of this <br />Agreement. <br />3. Compliance with Laws and Regulations. The Developer represents <br />to the City that to the best of its knowledge the construction of <br />improvements to serve the Park Place subdivision will comply with all City, <br />County, Metropolitan, State and Federal laws and regulations, including, <br />but not limited to, subdivision ordinances, zoning ordinances, noise <br />ordinances, burying of all utilities and environmental regulations; <br />including wetland impact and mitigation.
