Finding: The applicant plans to locate the pool hall within an existing commercial center. The subject property is zoned PUD and permits the uses allowed in the B -3, General Business District. Pool halls are a conditionally permitted use within this district. 4. The hours of operation shall be subject to City Council control and change as a means to maintain compatibility of uses and activities. Finding: This provision gives the City Council the authority to control the hours of operation to help insure compatibility with surrounding land uses. Since the applicant did not indicate his preferred hours of operation, the Planning Commission and City Council may wish to discuss with the Mr. Melloy the appropriate hours of operation. 5. The provisions of Section 921.010, C of this Ordinance are considered and satisfactorily met. Finding: Staff finds that this application and the subject property comply with Section 921.010, C of this Ordinance. RECOMMENDATION Staff recommends approval of a conditional use permit to allow the operation of a recreation center (pool hall) in Suite 420 of the Market Place Mall located at 2900 Rice Street. This recommendation is based on the findings contained in this report and subject to the following conditions: 1. No alcoholic beverages shall be sold or served in the subject property. 2. The subject property shall be limited to appropriate by the City Council. 3.
