The use is located and developed so as not to create an incompatible operation <br />problem with adjoining and neighboring commercial and / or residential uses. <br />Finding: The applicant plans to locate the pool hall within an existing commercial <br />center. The subject property is zoned PUD and permits the uses allowed in the B -3, <br />General Business District. Pool halls are a conditionally permitted use within this <br />district. <br />4. The hours of operation shall be subject to City Council control and change as a <br />means to maintain compatibility of uses and activities. <br />Finding: This provision gives the City Council the authority to control the hours of <br />operation to help insure compatibility with surrounding land uses. Since the <br />applicant did not indicate his preferred hours of operation, the Planning <br />Commission and City Council may wish to discuss with the Mr. Melloy the <br />appropriate hours of operation. <br />5. The provisions of Section 921.010, C of this Ordinance are considered and <br />satisfactorily met. <br />Finding: Staff finds that this application and the subject property comply with <br />Section 921.010, C of this Ordinance. <br />RECOMMENDATION <br />Staff recommends approval of a conditional use permit to allow the operation of a <br />recreation center (pool hall) in Suite 420 of the Market Place Mall located at 2900 Rice <br />Street. This recommendation is based on the findings contained in this report and subject <br />to the following conditions: <br />1. <br />No alcoholic beverages shall be sold or served in the subject property. <br />2. The subject property shall be limited to <br />appropriate by the City Council. <br />3.
