The <br />Rwctionality of the care facility depends an the prescribed arrangement of its resident and staff spaces within the <br />building and ultimately the building's relation to the site. Redesigning the building to fit within setbacks would <br />compromise the llmctiionality of the facility, while imposing significant redesign costs and schedule constraints. <br />The proposed variance would not be detrimental to the public health, welfare, or injurious to other property. The <br />'portion footprint of the proposed building encroaching the 15'4" building setback on the northeast side measures <br />4'-4" at the widest point, tapering down to 0" over a distance of 40'-0" along the setback line. The area of the building <br />footprint over the setback, 84 square feet, equates to 2.1% of the total building footprint (3972 square feet). Futther, <br />fireside of the property with the setback encroachment abuts the St. Paul Water Works right -of -way property, posing <br />no balm to public or private property. <br />The curved property line abated with St. Paul Water Works property tapers the site buildable area necessitating the <br />variance to the building setback. The site offers a 62'4" width within setbacks along the northwest property line <br />(entry location) which tapers down to a 30'-0" width within setbacks at the southeast end. The building and site plan <br />have been designed within the limits of the building code and State of Minnesota regulations to minimize <br />encroachment on building setbacks to the area as described. <br />As we discussed earlier, Professional Design Group considers the Northeast Residence Respite Home design an <br />appropriate use for the site which respects the intent of the planning and zoning ordinances.
