(b) Standards adopted by reference. The City hereby adopts, by this reference, <br />Minnesota Rules Parts 7080.0010 to 7080.0315 and 7080.0178 as now constituted <br />and from time to time amended, related to the location, design, construction, <br />operations, maintenance, repair, abandonment, inspection, and permitting of <br />individual sewage treatment systems. Warrantied Systems are specifically <br />prohibited in the City of Little Canada. <br />(c) Definitions. See Minnesota Rules Part 7080.0020. <br />(d) Permits. No person shall, install, alter, repair, or extend any individual sewage <br />treatment system in the City of Little Canada without first applying for and <br />obtaining a permit from the Building Official. Permit application shall include <br />submission of a site evaluation report and design information. Permit fees shall be <br />established by Council Resolution. Such permit shall be valid for a period of <br />twelve (12) months from the date of issuance. The Building Official, following the <br />completion of the work but prior to covering the system, shall inspect any <br />installation, alteration, repair, or extension of such systems. <br />(e) New and Replacement Systems <br />1. Individual or private sewage treatment systems may be permitted for new <br />detached single - family dwellings where it is clearly shown that there is a <br />hardship or practical difficulties in the extension of public sanitary sewer <br />service to the structure as determined by the City Engineer provided the <br />property is at least one acre minimum high ground in size. <br />2. All new or replacement individual sewage treatment systems must be sited, <br />designed, installed and maintained in accordance with Minnesota Rules Parts <br />7080.0010 to 7080.0315 as now constituted and from time to time amended. <br />3. New or replacement individual sewage systems shall be set back at least 150 <br />feet from the Ordinary High Water Line of Natural Environmental Waters and <br />at least 50 feet from the Ordinary High Water Line of General Development <br />Waters. <br />4. New or replacement on -site sewage treatment systems must be designed to <br />minimize or eliminate infiltration of flood waters and they shall not be subject <br />to impairment or contamination during times of flooding. <br />5. A compliance inspection shall be performed for all new or replacement <br />individual sewage treatment systems in accordance with Minnesota Rules Part <br />7080.0315. A Certificate of Compliance or Notice of Noncompliance must be <br />submitted to the City and the owner within 30 days of the inspection date. <br />(f) Existing Systems <br />1. Any modification, repair, alteration, or expansion of an existing individual <br />sewage treatment system must be in accordance with Minnesota Rules Parts <br />7080.0010 to 7080.0315 as now constituted and from time to time amended. <br />2. A compliance inspection shall be performed for any modification, repair, <br />alteration, or expansion of an individual sewage treatment in accordance with <br />Minnesota Rules Part 7080.0315.
