Developer may obtain which are highlighted in green and blue on the attached Exhibit B. <br />The width of the dedicated rights -of -way shall satisfy the requirements of the City's Zoning <br />and Subdivision Ordinances unless the City Council grants a variance pursuant to the <br />provisions of the City Ordinances. Developer's obligation to dedicate the southerly portion <br />of the property highlighted in green is subject to Developer's acquisition of such property. <br />Developer may condition Developer's dedication of right -of -way easements to the public <br />upon the City's agreement to release, within six months of the City's completion of <br />construction of Market Place Drive and Middle Street, of the City's rights under the <br />easement in favor of the City which is recorded as Document Nos. 2042433 (highlighted in <br />pink on the attached Exhibit B). The City may limit its release of easement rights so as to <br />preserve easements in areas where existing water, storm sewer or sanitary sewer <br />improvements are located. <br />b. Developer agrees to cooperate with the City for the redevelopment of the <br />property cross - hatched in yellow on the attached Exhibit B in a manner consistent with the <br />City's redevelopment objectives. <br />c. Developer agrees to dedicate public utility easements to the City for the water, <br />storm sewer and sanitary sewer mains which are located on the Property and which currently <br />serve a public purpose and to transfer ownership of the water and sanitary sewer mains <br />serving a public purpose to the City. Before transferring ownership of the water mains, <br />Developer shall pressure test the water mains. Before transferring ownership of the sanitary <br />sewer mains, Developer shall televise and inspect the sanitary sewer mains.
