MINUTES <br />CITY COUNCIL <br />OCTOBER 28, 1992 <br />parking, however, felt most parks did not have as <br />limited an amount of parking as this one. <br />PLAY 21 <br />AUTO SALES <br />ORDINANCE <br />LaValle asked about the Play 21 operation at the <br />Venetian Inn and the situation with customers making <br />social bets. LaValle asked if the City should obtain <br />an opinion from the Attorney General's office on social <br />betting. <br />The City Attorney did not believe the Attorney General <br />would give an opinion on social betting. The City <br />Attorney noted that the position that the Council took <br />with the Play 21 operation is that it did not want any <br />problems. If the City Council perceives a problem, it <br />is free to amend the ordinance to prohibit the Play 21 <br />operation. <br />The City Administrator reported that the Play 21 owners <br />have not encouraged the social betting and have taken <br />the position that it will not be allowed or tolerated <br />by any of their dealers. Play 21 understands the <br />Council's ability to amend the ordinance to prohibit <br />their operation should problems occur. <br />The City Planner submitted a proposed ordinance <br />regulating accessory auto sales in the Business and <br />Industrial Zoning Districts. The Planner also pointed <br />out the distance separation between such businesses of <br />500 feet proposed for the Industrial District. The <br />Planner noted that the ordinance requires that auto <br />sales be an accessory use to a principle business. The <br />ordinance also requires that the principle business <br />would have to occupy at least 1,000 square feet of a <br />building. The Planner also pointed out that the <br />accessory use must be clearly incidental to the <br />principle use of the property. <br />Blesener asked about the 500 foot required separation <br />from residential property, and pointed out the close <br />proximity of the trailer park to Ryan Industrial Park. <br />The City Planner pointed out that the trailer park is <br />not zoned Residential. <br />Blesener felt the 500 foot separation between similar <br />uses would be tight. <br />The Planner agreed and pointed out that the required <br />separation in the Business District is 2,000 feet. The <br />suggestion for a 500 foot separation is to avoid ending <br />up with a row of auto sales businesses. <br />Page 12 <br />
