MINUTES
CITY COUNCIL
FEBRUARY 10, 1999
proposed building would remain retail and not be converted to an
auto - related use.
The City Administrator indicated that one option that the staff
considered would be to rezone the property to PUD. However, this
is not a viable option given that auto - related uses are not allowed
in a PUD zone. The Administrator suggested that the property
would need to be rezoned to B -2 with a Conditional Use Permit for
the auto - related uses. The CUP could be restricted so that the
retail portion of the building would be prevented from converting
to auto - related use.
Fahey suggested that the applicant could be told to pursue his
proposal provided he was agreeable to a square footage limitation
on the auto- related uses.
Perry Linn reported that he is proposing that the front view of the
building from Rice Street would be 100% retail use. The backside
of the building would be used for auto - related uses.
Scalze asked if the south side of the building would have a brick
facade. Linn replied that it would while the Rice Street side of the
building would be glass with windows wrapping around about 25
feet of the south side of the building. Linn suggested that some
sort or architectural treatments would be used on the south side of
the building to break it up from having a long brick wall effect.
Scalze asked if outside storage was being proposed. Linn replied
that it was not. Linn anticipated the building would have 6 or 7
bays and 11 months of the year there would be no vehicles stored
outside.
LaValle asked the types of retail uses proposed for the building.
Linn's developer indicated that he was not sure at this point, but
suggested that retailers such as bagel or coffee shops were a
possibility. The developer felt there were a lot of non - auto - related
uses that would be appropriate for the site.
Fahey suggested that the limitation on the square footage for auto -
related use would be a part of either the Conditional Use Permit or
the Development Agreement. Fahey indicated that the Council is
willing to consider this concept because of the attractiveness of the
retail portion of the development and the fact that the development
Page 27
