8. No more than four licenses in effect throughout the City. <br />9. Licenses subject to annual review. <br />The primary issue raised by this application is requirement number 7, that of the 500 foot <br />spacing requirement. Currently, a licensee is in operation across the street from the <br />proposed Valor Enterprises site. As such, the applicant is requesting a variance from the <br />spacing standard. <br />Variances are reviewed as to whether the property may be put to reasonable use under <br />the terms of the ordinance, or whether there are special conditions existing on the property <br />which result in a hardship in complying with the Ordinance. In this case, it is difficult to <br />make a finding of hardship, since the property may be put to the auto repair use, or any <br />of several other permitted 1 -1 uses, without the variance. Since no proper variance finding <br />can be made, the 500 spacing requirement must apply, and therefore, the motor vehicle <br />sales lot CUP cannot be issued for this site. <br />Staff does not recommend approval of the variance or the CUP due to the lack of variance <br />criteria as noted in this report.
