Motor Vehicle Sales Lots in the B -2 and B -4 Districts are allowed by Conditional Use <br />Permit, based on an analysis of several factors. These are as follows: <br />1. Outside services and sales are associated with a principal building of at least 1,000 <br />square feet. <br />2. The entire sales lot and parking area is paved. <br />3. At least three hundred eighty square feet of sales lot area per vehicle is provided. <br />4. Adequate parking and loading is provided, per ordinance. <br />5. The parking and sales lots are curbed. <br />6. At least five feet of perimeter landscaping is provided. <br />7. The use is no closer than 200 feet from residential property and 2,000 feet from a <br />similar use. <br />8. A license for such use is available (maximum of four in the City, two in the Business <br />Districts). <br />9. License subject to annual review. <br />Tom's Auto Sales would appear to meet each of these requirements, with a few minor <br />modifications. The building is over 3,600 square feet in area. Although not detailed on <br />the plan, it is staff's understanding that the applicant intends to pave and curb the site in <br />accordance with ordinance requirements. The site would accommodate as many as 58 <br />sale vehicles within the fenced area. <br />The applicant has submitted a landscape plan which illustrates an extensive landscape <br />area in front of solid wood fence along County Road C. One issue is whether the intent <br />of this plan is to extend the landscaping into the public right -of -way. The site plan would <br />appear to show such a concept. The acceptability of this idea should be verified with the <br />public works director. As noted, the remainder of the site perimeter must also be <br />landscaped, to a dimension of five feet. The site plan is not specific on this landscaping. <br />The required parking for the site should be fourteen spaces to allow for employees, <br />customers, and other commercial visitors. The front area of the existing building can <br />accommodate this demand with ninety degree parking, leaving space for the gated access <br />to the sales area. If necessary a few of the spaces could easily be located inside the <br />fenced area. The property is approximately 280 feet from residential property to the north <br />along Rosewood Lane, and more than 500 feet from residential property to the east along <br />County Road C. With the comments made above, the Conditional Use Permit should be <br />acceptable. <br />Summary and Recommendations <br />The rezoning to B -4 would appear to be consistent with the Comprehensive Plan, and <br />would also be consistent with present and future land uses of the area. The Conditional <br />Use Permit application would be appropriate within the B-4 District, based on a finding that <br />Page 160 <br />
