MINUTES CITY COUNCIL JUNE 27, 2012 AMEND CUP & SUBDIVISION — 3250 SPRUCE STREET — LAPHAM HICKEY STEEL CONSENT AGENDA DEFINITION OF ASSEMBLY The foregoing resolution was duly seconded by McGraw. Ayes (5). Nays (0). Resolution declared adopted. Mayor Blesener reported that Lapham Hickey Steel has withdrawn their application for Amendment to Conditional Use Permit for proof of parking and Subdivision to consider the combination of two platted lots for the property located at 3250 Spruce Street, Lapham Hickey Steel. They have indicated that they are not ready to proceed at this time, and would reapply at the time they are prepared to proceed with an addition to their Little Canada facility. Keis introduced the following resolution and moved its adoption: RESOLUTION NO. 2012 -6 -110 - APPROVING THE CONSENT AGENDA WHICH CONTAINS THE FOLLOWING: *APPROVAL OF THE VOUCHERS; *AUTHORIZE EDIT COMPUTER PURCHASE FOR CABLE TV CHANNEL 16 AS RECOMMENDED BY THE CABLE TV PRODUCER; *APPROVAL OF THE CANADIAN DAYS FIRE WORKS CONTRACT AS RECOMMENDED BY THE CITY ADMINISTRATOR AND AUTHORIZING THE MAYOR AND CITY ADMINISTRATOR TO EXECUTE ON BEHALF OF THE CITY; The foregoing resolution was duly seconded by Boss. Ayes (5) Nays (0). Resolution declared adopted. The City Planner noted the recent issue in the City of St. Anthony relative to their definition of assembly in industrial zoning districts. The Planner indicated that this issue also arose earlier this year in the City of Wayzata. The Planner reported that the issue stems from a 2000 Supreme Court decision "Religious Land Use and Institutionalized Persons Act" (RLUIPA), which says that cities cannot treat religious organizations differently than non - religious organizations. There are a number of impacts from this decision. One is that church activities that are similar to commercial activities, like movie theaters where there are assemblies of people, must be treated the same. 3
