MINUTES <br />CITY COUNCIL <br />JUNE 27, 2012 <br />AMEND CUP <br />& SUBDIVISION — <br />3250 SPRUCE <br />STREET — <br />LAPHAM <br />HICKEY <br />STEEL <br />CONSENT <br />AGENDA <br />DEFINITION <br />OF <br />ASSEMBLY <br />The foregoing resolution was duly seconded by McGraw. <br />Ayes (5). <br />Nays (0). Resolution declared adopted. <br />Mayor Blesener reported that Lapham Hickey Steel has withdrawn <br />their application for Amendment to Conditional Use Permit for proof of <br />parking and Subdivision to consider the combination of two platted lots <br />for the property located at 3250 Spruce Street, Lapham Hickey Steel. <br />They have indicated that they are not ready to proceed at this time, and <br />would reapply at the time they are prepared to proceed with an addition <br />to their Little Canada facility. <br />Keis introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2012 -6 -110 - APPROVING THE CONSENT <br />AGENDA WHICH CONTAINS THE FOLLOWING: <br />*APPROVAL OF THE VOUCHERS; <br />*AUTHORIZE EDIT COMPUTER PURCHASE FOR CABLE TV <br />CHANNEL 16 AS RECOMMENDED BY THE CABLE TV <br />PRODUCER; <br />*APPROVAL OF THE CANADIAN DAYS FIRE WORKS CONTRACT <br />AS RECOMMENDED BY THE CITY ADMINISTRATOR AND <br />AUTHORIZING THE MAYOR AND CITY ADMINISTRATOR TO <br />EXECUTE ON BEHALF OF THE CITY; <br />The foregoing resolution was duly seconded by Boss. <br />Ayes (5) <br />Nays (0). Resolution declared adopted. <br />The City Planner noted the recent issue in the City of St. Anthony relative <br />to their definition of assembly in industrial zoning districts. The Planner <br />indicated that this issue also arose earlier this year in the City of Wayzata. <br />The Planner reported that the issue stems from a 2000 Supreme Court <br />decision "Religious Land Use and Institutionalized Persons Act" <br />(RLUIPA), which says that cities cannot treat religious organizations <br />differently than non - religious organizations. There are a number of <br />impacts from this decision. One is that church activities that are similar to <br />commercial activities, like movie theaters where there are assemblies of <br />people, must be treated the same. <br />3 <br />
