MINUTES <br />CITY COUNCIL <br />JUNE 27, 2012 <br />The City Planner reported that the application is for a three lot subdivision <br />for the property at the southwest corner of Condit Street and Yorkton <br />Ridge. There is an existing house on the property and the subdivision will <br />result in two new buildable lots. The Planner noted that the proposal <br />meets the City's zoning requirements. He also reported that a tree <br />inventory has been submitted for the proposed Lot 1. The City Planner <br />recommended approval subject to compliance with the recommendations <br />in his report as well as that of the City Engineer. <br />Linda Brown, Stantec Consulting Services representing TCF, appeared <br />before the Council and reported that an issue has arisen relative to this <br />property that may require the tabling of any action. Brown stated that <br />tabling action was acceptable to the applicant. <br />Julie Barthal appeared before the Council and reported that she has <br />entered into a purchase agreement for the property. She indicated that <br />there is conflicting information relative to the size of the property between <br />the MLS listing and County property records. Barthal indicated that there <br />may be misrepresentations of the property by either the realtor or TCF <br />Bank, the owner. She indicated that she was told the property she was <br />purchasing extended to the tree line. <br />The City Administrator suggested that the Council could complete the <br />public hearing and then table action until this matter is resolved between <br />Barthal and TCF Bank. He noted that there may be some performance <br />issues that need to be resolved relative to the purchase agreement. He also <br />pointed out that the City is not a party to these issues. <br />McGraw asked if Barthal was interested in subdividing the property. She <br />indicated that she was not. Barthal stated that her concern is that she was <br />told she was purchasing the property up to the tree line. The Planner <br />noted that if Barthal is purchasing up to the tree line, this would leave only <br />one lot to be subdivided from the property. The Planner indicated that <br />TCF Bank could revise the plat accordingly. The Planner also noted that <br />the Subdivision Ordinance provides the City with 120 days review time on <br />plats, therefore, tabling action on the plat would not be problematic. <br />Montour introduced the following resolution and moved its adoption: <br />RESOLUTION NO. 2012 -6 -109 — CONTINUING THE PUBLIC <br />HEARING AND TABLING ACTION ON THE APPLICATION FOR <br />PRELIMINARY AND FINAL PLAT FOR YORKTON RIDGE <br />ESTATES UNTIL THE JULY 25, 2012 REGULAR COUNCIL <br />MEETING <br />2 <br />
