Interest shall be charged at a five percent (5 %) interest rate for the duration of the <br />assessment. Owner hereby waives notice of assessment hearing for the abatement and <br />specifically waives her right to appeal said assessment as provided for in Minnesota Statutes <br />Section 429.081. <br />3. Owner agrees this agreement shall have the same force and effect as a petition <br />presented pursuant to Minnesota Statutes Section 429.031 and specifically waives any public <br />hearings with respect to the abatement. <br />4. Owner and Tenant will have the right to be present during the abatement <br />process, but may not interfere with the work of the City's agent. Should there by any <br />question as to the method employed in conducting the abatement operation, the final decision <br />shall rest with the City's agent. <br />5. The Owner and Tenant each agree to indemnify City and its agents against all <br />losses, claims, damages, liability and expenses, including without limitation costs and <br />investigation and legal counsel fees which may be incurred or imposed upon City in <br />connection with City's performance of its duties under this Agreement, including without <br />limitation any litigation or other non judicial proceedings arising from this Agreement or the <br />subject matter thereof. <br />8 <br />
