AGREEMENT <br />This agreement is made and entered into this t'B day of July, 2012 by and between <br />Camilla Dobbs, a single person, hereinafter referred to as "Owner ", Chuck Shell, a single <br />person, hereinafter referred to as "Tenant ", and the City of Little Canada, a Minnesota <br />Municipal Corporation, hereinafter referred to as "City ". <br />WITNESSETH: <br />The City is proposing to remedy code violations found to exist on Owner's property <br />located at 135 Viking Drive, East, Unit #302 and as outlined in the City's letter to Owner <br />(copy attached hereto). The property is legally identified as: <br />Apartment Ownership No. 016 Oakmont Condominium Apartments — Unit 302 <br />And is further identified by Property Identification Number 07- 29 -22 -42 -0065 <br />In the spirit of cooperation between the parties hereto, with the intent of expediting <br />the remedy of existing violations, City has requested and the Owner and Tenant have agreed <br />to grant permission to City and its agents to enter upon property with at least twelve hours <br />notice for the purpose of commencing abatement of the existing violations. <br />To date, Owner and Tenant have not been able to complete the work necessary to <br />abate the violation. An abatement of the violations is anticipated to be ordered by the City <br />Council of the City on July 11, 2012 assuming the City Council will determine it is in its best <br />interests to have the violations abated forthwith in order to correct the unsafe and hazardous <br />conditions now existing on the property and to assess the costs against the Owner thereof. <br />NOW THEREFORE, the undersigned, as Owner and Tenant respectively, of the <br />above described property, in consideration of the site being cleaned to eliminate the existence <br />of the current violations: <br />1. Owner and Tenant hereby grants to City and its agents, the right to enter upon <br />and conduct cleaning operations therein in a manner that will abate the existing fire code <br />violations. Owner shall provide City and/or its agents with a key for access to the property <br />while the abatement process is on going. The key shall be returned within 48 hours of <br />completion of the abatement activity. <br />2. Owner requests City assess the costs of clean -up together with a 15% <br />administrative fee against the property described above with such assessment and fee to be <br />spread over a five (5) year period with the first installment due with 2013 property taxes. <br />7 <br />
