J• <br />dispose of all refuse and garbage collected in Little Canada at a Refuse <br />Derived Fuel processing facility at which the operator has assumed all <br />liability arising from the Solid Waste Disposal Act, as amended by the <br />Resource Conservation and Recovery Act, the Comprehensive <br />Environmental Response, Compensation, and Feasibility Act, and <br />similar Federal and State Statutes. Any deviation of this provision shall <br />be considered a violation and default of this Contract. The Contractor <br />shall maintain actual Ramsey /Washington RDF receipts and shall <br />provide the City with copies of such receipts. Estimated Little Canada <br />tonnages shall be reported to the City bi- annually. All costs associated <br />with disposal (tipping fees) shall be based upon fees net of any rebates <br />that the Contractor may be eligible for, regardless of when (or if) <br />received by the Contractor. It shall be understood that the disposal rate <br />in Exhibit A shall be based upon the lowest available tipping fee charged <br />by the RDF facility to an entity that takes all material to the RDF facility <br />for disposal. <br />Notification. If any resident of the City places any items out for pickup <br />and the item is not taken by the Contractor, the Contractor shall provide <br />immediate written notification to the resident and the City of reason(s) <br />for refusal to pick up the item. Notification must be left on the item(s) in <br />question. <br />k. Exceptions for Handicapped and /or Disabled. The Contractor shall <br />make reasonable exceptions as to the manner of pickup for handicapped <br />or disabled residents. <br />2. Yard Waste Collection. <br />a. Description. Yard waste collection service shall include the collection <br />of all yard waste from participating residential dwelling units in the City <br />of Little Canada. Cost for this service is described in Attachment "A." <br />b. Containers. Residential dwelling units shall have their yard waste <br />segregated from other refuse in a container clearly identified as "Yard <br />Waste" located at the boulevard adjoining the curb on or before 7:00 <br />a.m. on the designated day of collection. Additional bags and /or clearly <br />identified containers may also be placed curbside at each pickup without <br />limit to quantity. Containers should not exceed 60- gallon capacity nor <br />weigh more than 50 pounds when filled. Bags should not be filled so as <br />to exceed their structural capacity. <br />c. Frequency. Yard Waste Collection Service shall be provided from <br />April 15( through November 30th each year and each residential dwelling <br />-6- <br />
