MINUTES <br />CITY COUNCIL <br />JULY 25, 2012 <br />Keis noted that the Klidzejs driveway is on public property. Norma <br />Klidzejs indicated that the situation was established years ago when her <br />father -in -law built the house to the west of the Mercil's. There was <br />discussion at the time relative to access, and Klidzejs indicated that the <br />City did not require the improvement of Mitchell Trail at the time. <br />Aleks Klidzejs reviewed the existing easements and rights -of -way in this <br />area. He suggested that rather than allowing the Mercil property access to <br />the south, that the City require the new garage be constructed on the north <br />and allow the Mercil's a Variance to place the garage five feet from the <br />northern property line. This would result in a 16 foot separation between <br />the front of the house and the new garage. Aleks Klidzejs pointed out that <br />having the garage on the north maintains the existing access to the north <br />and does not open access to his driveway on the south. <br />Klidzejs felt a shared driveway on the south would result in safety <br />concerns. He reviewed pictures of the area and indicated that there are <br />children that use his driveway to access the lake. He felt the additional <br />traffic and the fact that sight lines are not clear would be a safety concern. <br />Klidzejs felt there was enough space to place the garage on the north and <br />avoid the safety concerns. He again suggested a variance from the north <br />property line to gain more separation between the house and garage. <br />Blesener suggested that if the garage is placed on the north, it be pushed <br />east to allow enough space for parking in front of the garage. The city <br />Planner indicated that there should be at least a 20 foot setback from the <br />west property line to provide adequate parking area in front of the garage. <br />The Council discussed a concern raised relative to guest parking on the <br />driveway to the south. The City Administrator reported that issues such as <br />parking could be addressed in a license agreement. The Administrator <br />also indicated that there should be a license agreement in place to govern <br />the driveway use over a public right -of -way. He noted that currently <br />Norma and Aleks Klidzejs are using this right -of -way on the south with <br />the permission of the City. If that driveway is shared, a license agreement <br />would govern future improvements, maintenance, etc. The Administrator <br />indicated that ideally a shared driveway situation would not exist. <br />Keis indicated that his opinion is that the Mercil property should not have <br />two driveway accesses. He noted that the northern access is via a private <br />easement agreement. The southern access would be over a public <br />easement and right -of -way. Keis stated that he did not know if allowing <br />the Mercil's to have access from the south would impact the Klidzejs' <br />property values. He indicated that to him the southern access was the best <br />solution and that a maintenance agreement would have to be worked out. <br />6 <br />
