MINUTES <br />PLANNING COMMISSION <br />JULY 8, 1999 <br />replied that the applicants have until December 31, 1999 to be in <br />compliance. <br />Mr. Keis recommended approval of the Conditional Use Permit to <br />allow open and outdoor storage of trucks, construction equipment, <br />and materials as an accessory use for the property at 3171 Spruce <br />Street, D.N.R. Construction, subject to compliance with the <br />recommendations of the Zoning Administrator as outlined in her <br />report dated June 28, 1999. <br />Motion seconded by Kraemer. <br />Motion carried 7 — 0. <br />FENCE Mr. Terry Reeves, 72 Jessica Court, appeared before the <br />HEIGHT Commission requesting approval of a Variance to allow the <br />VARIANCE — construction of an 8 '/ foot high privacy fence at the rear yard <br />72 JESSICA property line adjacent to County Road C. Reeves indicated that <br />COURT — he would like to replace his existing fence and construct a new one <br />REEVES making the height conforming to the fences of the neighboring <br />properties. <br />Duray asked if the fence would exist only at the rear property line <br />or if there would be side fence sections as well. Reeves replied <br />that the fence would be at the rear property line only. <br />The City Planner indicated that there has been an issue of <br />maintenance of the property at the back of the Reeves' fence. As a <br />condition of the variance approval, the Zoning Administrator is <br />recommending that the applicant be required to maintain this area. <br />There is an approximately three -foot strip between the back of the <br />fence and the paved path along County Road C. <br />Reeves pointed out that County Road C is a County road and the <br />County is responsible for this maintenance. Reeves indicated that <br />the County has informed him that because of a lack of manpower, <br />they have not been maintaining the area. <br />The Zoning Administrator pointed out that the boulevard area of <br />the majority of yards is public right -of -way. However, property <br />owners are expected to maintain these areas. While the County has <br />been maintaining the boulevard between the street and the <br />sidewalk, they have not been maintaining the strip between the <br />sidewalk and the fence.
