northwest associated consultants, inc. <br />PLANNING REPORT <br />TO: Little Canada Planning Commission <br />FROM: Stephen Grittman <br />DATE: 11 September 1989 <br />Little Canada - Stanke Building Variance <br />758.09 - 89.50 <br />RE: <br />FILE: NO: <br />BACKGROUND <br />Roger Stanke on the north side of Ryan Drive in Ryan Industrial <br />Park. The existing building is set back toward the Burlington <br />Northern Rail line, 6.28 feet from the rear property line. Mr. <br />Stanke wishes to expand his facility to the west. The building <br />addition is proposed to be. "off set"' from the existing building <br />encroaching into the NSP easement_. The applicant has requested a <br />variance to allow the addition to extend into the required 20 <br />foot rear setback. <br />ANALYSIS <br />The Zoning Ordinance includes several criteria to determine <br />whether or not a variance proposal qualifies as a hardship_ One <br />of these is unusual shallowness of an existing platted parcel of <br />land. This particular lot is quite shallow for an industrially <br />zoned lot and in addition, a 65 foot wide NSP easement extends <br />across the breadth of the parcel, further restricting its <br />buildable area. <br />We believe this parcel qualifies for variance approval with the <br />stipulation that the expansion not exceed the setback variance of <br />the existing building, and that the applicant demonstrates that <br />NSP has approved of the encroachment into the easement, in <br />.writing_ As a result, we would recommend that the 6..28 foot . <br />setback of the existing business be met. or exceeded by the. <br />,addition_ The: submittedi site plan currently shows & 5 -E foot <br />setback.. <br />Page 126 <br />4601 excelsior blvd., ste. 410, minneapou, u (612) 925 -9420 fax 925 -2721 <br />
