MINUTES <br />PLANNING COMMISSION <br />SEPTEMBER 9, 1999 <br />Keis stated that he has a concern with the granting of variances for <br />this proposal. He also indicated that he would prefer that Bryan <br />Street is a through street, and feels a cul -de -sac would cause other <br />problems. On the issue of private versus public street, Keis <br />indicated that he was not sure. <br />Howe pointed out that there is a private street system in <br />Cobblestone Village that works well. Howe stated that with a <br />private street he would be able to meet setbacks except for the <br />units that abut the park. Howe agreed it might be possible to <br />shorten the width of the park to 113 feet, adding 7 feet to the <br />townhome site and eliminating the variance for the northerly units. <br />Howe pointed out that the townhome association would maintain <br />the road through the collection of monthly fees from the townhome <br />property owners. <br />Keis asked what happens if the association ceases to exist. Howe <br />reported that as long as there are people living in the townhomes, <br />the association would exist. A townhome cannot be sold unless <br />association fees are current. The City Planner indicated that in the <br />past there had been concern about the longevity of townhome <br />associations. However, these legal concerns are addressed in the <br />current townhome documents that are being developed. <br />Barraclough asked about front yard setbacks for the townhomes. <br />Howe reported that he is proposing 25 feet from Bryan Street and <br />30 feet from Jackson Street. Howe indicated that he can meet the <br />setbacks for the development, other than for the units against the <br />park. He further stated that a 125 -foot wide park would make a <br />better park. Howe indicated that he would like to see the property <br />rezoned to either PUD or R -2. <br />Duray stated that he had no problem with the proposal in general. <br />However, he would like to see Bryan Street go through, and he <br />would like to see it a public street. Duray felt that the City would <br />have more control over the maintenance of the street. <br />Knudsen felt that maintenance was a non -issue given there would <br />be a townhome association in place. <br />Montour asked if a private street was allowed in an R -2 District. <br />The Planner replied that it was with a PUD overlay. <br />Knudsen pointed out that the City has turned down variances for <br />other property owners requesting them in order to construct <br />Page 33 <br />
