MINUTES <br />PLANNING COMMISSION <br />SEPTEMBER 9, 1999 <br />Keis asked if an electrical business moved out of the site, if it <br />would be replaced with a plumbing business. The Planner reported <br />that both businesses would be classified as a contractor shop and <br />would be the same type of business for purposes of the ordinance <br />and use of the property. The Planner agreed with Knudsen's <br />comment about businesses being destroyed by more than 50% not <br />being re- established. He also noted that if a use on the property is <br />discontinued for more than 6 months, it would not be allowed to <br />re- establish. <br />Keis pointed out the McCumber property has several businesses <br />operating from it. He asked if one moves out and that particular <br />space is not leased for six months or more, if that space would then <br />be required to conform to the zoning. The Planner was not sure, <br />and suggested that the City Attorney would have to make an <br />interpretation on that issue. <br />Ed McCumber, 608 County Road D, asked when the Comp Plan <br />was updated and why the City is so intent on seeing this property <br />rezoned to residential. He pointed out that he has owned the <br />property for 24 years and their building has existed for 22 years. <br />McCumber further estimated that the I -1 zoning has been in place <br />for 30 to 32 years. McCumber pointed out that this is a freeway <br />corner. There is commercial development on the other side of <br />County Road D in Vadnais Heights. He noted the commercial <br />development that exists in Little Canada along County Road D <br />further to the west. <br />McCumber submitted a petition from the property owners in the <br />area opposing the rezoning of these properties. <br />McCumber stated that he does not know why the City wants to <br />rezone the property. It noted that the corner of Edgerton and <br />County Road D is a commercial corner and is a noisy corner. He <br />did not feel anyone would want to construct a residential <br />development on the corner. <br />Montour asked what representations McCumber made to property <br />owners in obtaining signatures on the petition. McCumber <br />reported that he informed the property owners that the City is <br />considering the rezoning of the corner and that the property could <br />be rezoned to residential. Knudsen asked if the property owners <br />are opposed to residential zoning. McCumber indicated that they <br />did not oppose single - family residential. However, McCumber <br />pointed out that single- family would not be feasible given only <br />Page 42 <br />
