Setbacks <br />* See attached site plan dated August 27, 1999 <br />Front yard <br />Side yard <br />Rear yard <br />Open & Outdoor Storage <br />40 feet from the property line <br />Not less than fifteen (15) feet when abutting non - residentially <br />zoned property. <br />Not less than thirty (30) feet when abutting residentially zoned <br />property. <br />Not less than thirty (30) feet. <br />The applicant is requesting a new use of open and outdoor storage of equipment and <br />materials in the side yard. The zoning ordinance permits exterior storage of materials and <br />equipment to be stored in the side or rear yards by conditional use permit (CUP). <br />The Public zoning district allows the operation and storage of vehicles, equipment and <br />machinery which are incidental to permitted or conditional uses allowed in this district as a <br />permitted accessory use. The storage of materials and equipment may encroach into the <br />side and rear yard setback, but in no case shall equipment and materials be located closer <br />than 10 feet to a rear yard or side yard lot line. (903.020.D.3) <br />Open and outdoor storage as an accessory use is permitted in the side and rear yards with <br />a conditional use permit within the Public zoning district provided the following conditions <br />are' met: <br />1. The storage area is fenced and screened from view of neighboring residential uses and <br />local public right -of -way in compliance with Section 903.020.G if this Ordinance. <br />Screening materials may include chain -link fence with slats when abutting an "1 -1" Light <br />Industrial District. <br />2. Materials must be necessary for the health, safety and general welfare of the <br />community. The maximum amount of stockpiled materials must be indicated on the <br />approved site plan in cubic yards and approved by city council. <br />3. The storage area must be surfaced with asphalt, concrete or material approved by the <br />Council. The surfacing should be compatible with materials being stored upon the <br />area. <br />4. All lighting shall be hooded and so directed that the light source shall not be visible <br />from the public right -of -way or from neighboring residences and shall be in compliance <br />with Section 903.020.1 of this Ordinance. <br />5. The storage area must not take up required parking space as required for conformity to <br />this Ordinance. <br />6. The provisions of Section 921.010.0 of this Ordinance are considered and satisfactorily <br />met. <br />Page 10 <br />
