RECOMMENDATION <br />Based on the information discussed in this report, staff recommends the approval of the <br />proposed conditional use permit (CUP) application for an accessory use of open and <br />outdoor storage of equipment and materials in the side yard as indicated on the site plan <br />subject to the following recommendations: <br />1. The equipment and materials storage areas as defined in this report and as shown on <br />the site plan must be contained, maintained and arranged in a manner as to have a <br />well- organized and uncluttered appearance. <br />2. The outdoor storage area must be fully screened from the public right -of -way. The <br />wood and /or chain link fences with plantings are acceptable materials for screening <br />purposes in this district. <br />3. The chain link fence with slats must be removed and the proposed new screening <br />materials must be established as stated in this report and indicated on the site plan. <br />4. The equipment and materials must be stored in the rear yard and may in encroach into <br />the side and rear yard setback, but in no case shall equipment be located closer than <br />ten (10) feet to a rear yard or side yard lot line. <br />5. The maximum amount of materials allowed will be fifty (50) cubic yards with the <br />exception of sand /salt mixture of up to four- hundred (400) cubic yards with a maximum <br />height of fifteen (15) feet for the sand /salt mixture pile. <br />6. The trash dumpster may be stored in the side yard if it is fully screening from the pubic <br />right -of -way. <br />7. The storage area must be surfaced and maintained with asphalt, bituminous, concrete <br />or Class V material. <br />8. All lighting shall be hooded and so directed that the light source shall not be visible <br />from the public right -of -way and must be in compliance with Section 903.0201 <br />9. The required eleven (11) parking spaces must be established on the property. <br />10.The wood chip pile should be removed if it can not be adequately screened from the <br />public right -of -way as required by the zoning ordinance. <br />11.AII of the above mentioned conditions must be completed by December 31, 1999. <br />12. Property compliance with other zoning code compliance issues mentioned in the <br />following section. <br />Other Zoning Code Compliance Issue <br />1. Curb cut access exceeds twenty -four (24) feet on this property. <br />• The curb cut access may exceed twenty -four (24) feet with the approval of the <br />City Engineer due to equipment and /or truck access requirements for business. <br />The curb cut access was designed and approved by the City Engineer when the <br />road was rebuilt in 1981. (81 -12). <br />• The Public Works Director conducted an onsite evaluation using existing <br />equipment for the potential reduction to the standard curb cut access.
