Hanson <br />Email: cityhall @ci.little- canada.mn.us <br />MEMORANDUM <br />TO: Mayor Fahey & Members of the City Council <br />FROM: Joel Hanson, City Administrator <br />DATE: October 8, 1999 <br />RE: Deeds for Countryside Terrace Office Park <br />Dick Biagini is proceeding with construction of a 30,000 square foot office building on the Country Drive <br />redevelopment site. I also understand he is nearing completion of an agreement for the sale of the north <br />portion of the property to house an upscale office /warehouse building. To enable him to proceed, he <br />needs to be able to obtain the mortgage on the property for construction financing. To do so, requires the <br />approval of legal descriptions on a metes and bounds basis prior to platting. <br />Our Subdivision Ordinance Section 1009.020 provides that the Council may waive compliance with <br />platting requirements and allow conveyance by metes and bounds when compliance with the platting <br />restrictions creates an unnecessary hardship and failure to comply does not interfere with the purpose of <br />subdivision regulations (copy attached). <br />Given the fact that this property will be platted in the next few months, it would seem more than <br />reasonable to allow conveyance by metes and bounds at this point in time to facilitate mortgage financing. <br />(The City Planner concurs with this statement.) If the Council agrees, a resolution approving conveyance <br />by metes and bounds should be approved contingent upon the platting of this property by no later than <br />February 1, 2000 and subject to the City's acquisition of the Precision Tree parcel. (Therefore, this <br />conveyance would not take place until we have closed on that property.) <br />Dennis Unger of CI Title, Inc. is preparing the two deeds to facilitate the conveyance from the City to <br />RAB, LLC. The deeds will be based upon the legal descriptions attached.
