City Staff recommends the denial of the five (5) foot variance to reduce the off- street <br />parking setback requirement from five (5) feet to zero on Ryan Drive. The findings of <br />fact are as follows: <br />1. The strict enforcement of the zoning ordinance does not preclude the applicant from <br />establishing an adequate number of off- street parking stalls on the property. <br />2. The building meets the required forty -foot front yard setback. The placement of the <br />building does not preclude the applicant from established parallel parking in the front <br />yard to meet zoning code requirements. <br />3. Should the City decide to alter the road in the future, the twenty -five (25) foot <br />distance could be reduced and the off- street parking could be closer than the <br />required fifteen (15) foot setback. <br />Should the Planning Commission and City Council decide that this variance should be <br />approved, the following findings of fact would apply. <br />1. The five -foot variance would keep with the spirit and intent of the zoning ordinance in <br />the establishment of green areas from the road surface to the off- street parking area <br />as the public right -of -way extends twenty -five (25) feet from the surface of the street <br />to the applicants' property line due to center of the public- right -of -way swinging to <br />the south. <br />2. Green areas will be established between the street surface and the off - street parking <br />area to meet all other zoning requirements (25 ft. Ryan Drive & 15 ft Ryan Lane). <br />3. It is highly unlikely that the City would implement road improvements and or changes <br />to swing the public right -of -way more than ten (10) feet to the south. <br />Other Zoning Code Compliance Issues <br />1. The off- street parking areas and associated drives must paved with asphalt, <br />bituminous or concrete and striped with white or yellow paint lines not less than four <br />(4) inches wide. <br />2. The off- street parking area must have curbing (may use concrete curb stops) around <br />the entire parking lot. <br />3. Removal of unlicensed vehicles from the front and side yards within ten (10) <br />business days. <br />4. Remaining customer and /or employee licensed vehicles must be parked in a <br />designated parking space. <br />5. Removal of one curb cut access on the east side of the property and boulevard <br />landscaped. <br />6. All curb cut accesses must be no more than twenty -four feet in width to meet zoning <br />code guidelines. <br />7. Property owners are responsible for compliance with Minnesota State Statute <br />requirements regarding the establishment and compliance of handicap parking <br />guidelines. <br />Page 6 <br />
