MINUTES <br />PLANNING COMMISSION <br />DECEMBER 9, 1999 <br />Kimmes reported that the City Engineer is requesting a level grade <br />for the street in order that the proper drainage is obtained. Kimmes <br />did not feel this imposed any hardship on him or the plat. <br />Mr. Carson recommended approval of the Final Plat for the <br />Gilanderi Addition as well as a five -foot Variance from front yard <br />setback requirements for Lot 4 subject to compliance with the <br />recommendations of the City Planner and the City Engineer. <br />Motion seconded by Knudsen. <br />Motion carried 7 — 0. <br />REZONING Mr. Dave Langer appeared before the Commission requesting a <br />FROM BW TO rezoning of the Mueller property on County Road B from Business <br />B -3 — Warehousing (BW) to General Business (B -3). Langer described <br />MUELLER the location of the property as well as the surrounding property <br />PROPERTY uses. Mr. Langer reported that the rezoning is being requested to <br />accommodate development of a retail sporting goods business on <br />the site. <br />Duray asked if PUD zoning would be more appropriate given that <br />there is already PUD zoning in the area. <br />The City Planner indicated that the use would be allowed under a <br />PUD zone, however, a PUD permit would be required as well. <br />The Planner noted that the Comp Plan calls for commercial uses on <br />this site, therefore, the B -3 zoning would be appropriate. The <br />Planner acknowledged that while the B -3 zoning may look out of <br />place on the Zoning Map, it is consistent with the land use plan in <br />the Comp Plan. He also pointed out that the B -3 zoning will <br />provide the City with architectural review of the building. <br />Montour expressed concern that the sporting goods business would <br />be selling guns, and noted the two schools in this area. Mr. Langer <br />reported that the business would have to be licensed by the State <br />for firearms sale, and would have to comply with all State <br />requirements. <br />Mr. Barraclough recommended approval of the rezoning of the <br />Muller property on County Road B from Business Warehousing <br />(BW) to General Business (B -3) as recommended by the City <br />Planner. <br />Page 82 <br />
