MINUTES
PLANNING COMMISSION
DECEMBER 9, 1999
Kimmes reported that the City Engineer is requesting a level grade
for the street in order that the proper drainage is obtained. Kimmes
did not feel this imposed any hardship on him or the plat.
Mr. Carson recommended approval of the Final Plat for the
Gilanderi Addition as well as a five -foot Variance from front yard
setback requirements for Lot 4 subject to compliance with the
recommendations of the City Planner and the City Engineer.
Motion seconded by Knudsen.
Motion carried 7 — 0.
REZONING Mr. Dave Langer appeared before the Commission requesting a
FROM BW TO rezoning of the Mueller property on County Road B from Business
B -3 — Warehousing (BW) to General Business (B -3). Langer described
MUELLER the location of the property as well as the surrounding property
PROPERTY uses. Mr. Langer reported that the rezoning is being requested to
accommodate development of a retail sporting goods business on
the site.
Duray asked if PUD zoning would be more appropriate given that
there is already PUD zoning in the area.
The City Planner indicated that the use would be allowed under a
PUD zone, however, a PUD permit would be required as well.
The Planner noted that the Comp Plan calls for commercial uses on
this site, therefore, the B -3 zoning would be appropriate. The
Planner acknowledged that while the B -3 zoning may look out of
place on the Zoning Map, it is consistent with the land use plan in
the Comp Plan. He also pointed out that the B -3 zoning will
provide the City with architectural review of the building.
Montour expressed concern that the sporting goods business would
be selling guns, and noted the two schools in this area. Mr. Langer
reported that the business would have to be licensed by the State
for firearms sale, and would have to comply with all State
requirements.
Mr. Barraclough recommended approval of the rezoning of the
Muller property on County Road B from Business Warehousing
(BW) to General Business (B -3) as recommended by the City
Planner.
Page 82
