It is intended to summarize the City's review of the questions raised regardirc <br />the installation of a concrete patio by Mr. Kueppers on his property at 2420 Sunrise Drive <br />adjacent to property owned by Mr. Houle at 2430 Sunrise Drive. It is the unders:andinc <br />City Star' that Mr. Houle has objected to the location of the patio based on two concs..., <br />or Ci that "' <br />one concern is over the drainage from that improvement. and a second is.a c:aim ,a� to <br />location of the patio violates the City's Zoning Ordinance. A third abiecdon was raised <br />regarding the use of the space for storage. It is City Staffs opinion that the Zonin_ <br />Ordinance precludes any outdoor star-ace in at least the ten feet adjacent to the proper! <br />line. Mr. Kueopers was informed of this issue, and has agreed to remove any such stc, ag3 <br />from the area. <br />With regard to the drainage issue, the City believes this to be a matter between the two <br />private propeny owners, and not one in which the City has any invoivernent. As discussed <br />with both parties, improvements such as poured concrete on private progeny typically to <br />not require any City permit or review. The City makes no representations as to the prccer <br />installaton of the patio for any purpose. <br />With regard to the Zoning Ordinance, star has indicated that pouring concrete has rct <br />been interpreted to be subject to the setbacks or setback exclusions. My interpretation :- <br />Section 903.030.C. has been that patios are not within the meaning of any of these <br />improvements mentioned in this section.
