Hanson
Email: cityhall @ci little - canada.mn.us
TO: Mayor & City Council Members
FROM: Elizabeth Mursko, Zoning Administrator
DATE: November 17, 1999
RE:
Extension of December 31, 1999 Deadline for Saturn Transportation
Systems, Inc.
Mr. James McMahon, President of Saturn Transportation Systems, Inc., has requested
an extension to the December 31, 1999 deadline to remove transportation trailers from
the vacant property at the corner of South Owasso Boulevard and Spruce Street. Azure
Properties rents this property to Saturn Transportation on a month to month basis (see
the attached letters).
We (Steve Grittman, Jim LaValle and myself) met with Azure Properties (Tom Schuette)
at city planning hours in January (1999) to discuss the removal of the unlawfully
established use (exterior storage of trailers) and /or other possible solutions for this
property. This property is located in the "1 -P" District, which allows exterior storage as
an accessory use and does not provide for a principal exterior storage use as in the
"B -W" and "1 -1" districts. If this property had a principle use (building) that had a need
for off - street semi - trucking and trailer loading use involving the receipt or distribution of
materials or merchandise, it would be considered a permitted accessory use. If semi -
truck or trailer parking were necessary, it would require a Conditional Use Permit in this
district.
My recommendation would be not to extend the current deadline, as this was never a
lawfully established use. In addition, I would not recommend amending this district to
include a principle exterior storage, as this is not the intent of this district. The purpose
of this district is to provide for the establishment of warehousing and limited industrial
activities including the limitation on exterior storage in a "campus' type setting. Please
keep in mind that this is not a negative reflection on Saturn Transportation Systems, Inc.
but rather deals with the consistent application of the zoning ordinance. Should the
Council choose to extend this deadline, my recommendation would be limited to six
months (June 30, 2000).
CC: James McMahon, President of Saturn Transportation Systems, Inc.
Thomas Schuette, Azure Properties
Kathy Glanzer, Deputy Clerk
Page 85
