Hanson <br />Email: cityhall @ci little - canada.mn.us <br />TO: Mayor & City Council Members <br />FROM: Elizabeth Mursko, Zoning Administrator <br />DATE: November 17, 1999 <br />RE: <br />Extension of December 31, 1999 Deadline for Saturn Transportation <br />Systems, Inc. <br />Mr. James McMahon, President of Saturn Transportation Systems, Inc., has requested <br />an extension to the December 31, 1999 deadline to remove transportation trailers from <br />the vacant property at the corner of South Owasso Boulevard and Spruce Street. Azure <br />Properties rents this property to Saturn Transportation on a month to month basis (see <br />the attached letters). <br />We (Steve Grittman, Jim LaValle and myself) met with Azure Properties (Tom Schuette) <br />at city planning hours in January (1999) to discuss the removal of the unlawfully <br />established use (exterior storage of trailers) and /or other possible solutions for this <br />property. This property is located in the "1 -P" District, which allows exterior storage as <br />an accessory use and does not provide for a principal exterior storage use as in the <br />"B -W" and "1 -1" districts. If this property had a principle use (building) that had a need <br />for off - street semi - trucking and trailer loading use involving the receipt or distribution of <br />materials or merchandise, it would be considered a permitted accessory use. If semi - <br />truck or trailer parking were necessary, it would require a Conditional Use Permit in this <br />district. <br />My recommendation would be not to extend the current deadline, as this was never a <br />lawfully established use. In addition, I would not recommend amending this district to <br />include a principle exterior storage, as this is not the intent of this district. The purpose <br />of this district is to provide for the establishment of warehousing and limited industrial <br />activities including the limitation on exterior storage in a "campus' type setting. Please <br />keep in mind that this is not a negative reflection on Saturn Transportation Systems, Inc. <br />but rather deals with the consistent application of the zoning ordinance.
