MINUTES <br />PLANNING COMMISSION <br />APRIL 8, 1999 <br />Keis summarized that if no additional uses are added to the site, the terms <br />and conditions of the 1983 CUP would be in effect. If the towing <br />company stores its tow trucks on the site, the CUP would need to be <br />amended and additional conditions would be placed on the site, such as <br />the requirement of paving for the entrance area and employee parking. <br />Keis suggested that the Planning Commission could recommend a six - <br />month time period within which Mr. Carle would have to do the paving. <br />The City Planner suggested that the Planning Commission can act on the <br />application for CUP amendment, place the conditions it feels necessary on <br />the CUP, and then Mr. Carle can decide whether or not to activate the <br />permit. If the permit is not activated within six months, it would lapse. <br />The Planner also pointed out that whether or not Mr. Carle activates the <br />permit, the code enforcement issues identified by the City would still be <br />pursued. <br />Montour asked if a new CUP application was needed given the original for <br />the impound lot is now being changed to reflect the office use and the <br />storage of tow trucks. The City Planner indicated that the application <br />before the Commission was sufficient. <br />The Code Enforcement Officer recommended that the conditions which <br />should be placed on the permit include paving of the entrance area and <br />employee parking area, curbing as needed, and marking of the parking lot <br />with designated parking spaces. <br />The City Administrator recommended that Mr. Carle be required to submit <br />an updated site plan with better dimensions on the storage areas and <br />showing where the tow trucks will be parked, to ensure future compliance <br />with the CUP requirements. <br />Montour asked if any approval should clearly state that the primary use of <br />the site continues to be a landscaping business. The City Planner felt that <br />was not necessary, but pointed out that the CUP should set a specific limit <br />on the number of tow trucks to be stored on the site. Montour asked about <br />a limit on the hours of operation. The consensus of the Commission was <br />not to limit the hours of operation given the location of the business. <br />Mr. Keis recommended approval of a Conditional Use Permit allowing the <br />storage of up to four tow trucks on the property at 3101 Country Drive as <br />well as the office use for Swift Towing subject to compliance with the <br />recommendations of the Code Enforcement Officer which include paving <br />of entrance areas and employee parking area, curbing as needed, marking <br />of the parking lot with designated parking spaces, and submission of a site <br />plan showing the dimension of storage areas and designated area for tow <br />Page 29 <br />
