(651) 2227541 <br />Faesfmile <br />(651) 223-52E9 <br />There is no question that lower tenant's liability limits than the statutory limits of the City <br />are easier to obtain by prospective tenants. Therefore the rental of the old fire hall would be <br />more attractive from the standpoint of the tenant. <br />However, listing the City of Little Canada as an insured on the tenant's personal liability <br />policy allows the City to tender the defense of claims to the tenant's insurance carrier to the <br />extent of the coverage. Therefore, higher insurance limits, naming the City as an insured, is <br />more advantageous to the City than lower limits. Plaintiffs may allege claims in excess of the <br />insurance Iimits on a tenant's policy if any of.the allegations relate to negligence of the City of <br />• Little Canada. This is possible even though the insurance limits would be in the same amount or <br />in excess of the City's statutory limits, which presently are $300,000.00 per claim and <br />$750,000.00 per single occurrence. The statutory limits per occurrence will increase to <br />$1,000,000.00 after January 1, 2000. Therefore, the requirement of higher limits, naming the <br />City' as an insured, will not necessarily preclude a plaintiff from suing the City. <br />Would you please submit this to the Council for their consideration.
