• The signage is not in compliance with the zoning code. <br />• If this application is approved, the new use will be subject to the current <br />zoning code requirements which is reflected in the recommendations located <br />in the Planning Report dated March 18, 1999. <br />Based on the information discussed in the Planning Report dated March 18, 1999, staff <br />can not recommend approval of the proposed application for a PUD permit for open and <br />outdoor storage as the action should be based on specific findings of fact relating to the <br />City's Comprehensive Plan and the site in question. The findings of fact include: <br />(1) The proposed mix of uses in not consistent with the intent of the land use <br />plan. <br />(2) Several conditions on the site are out of conformance with the requirements <br />of the Zoning Ordinance and /or previous approvals. <br />(3) The proposed new use is inconsistent with the PUD District's objectives of <br />higher quality site design and conditions than the Zoning Ordinance would <br />otherwise require. <br />If the Council approves this application for a PUD permit, I would request that a <br />performance bond be posted to ensure the conditions of the PUD permit along with the <br />recommendations in the planning report dated March 18, 1999 are met. <br />CC: Joel Hanson, City Administrator <br />Steve Grittman, City Planner <br />Kathy Glanzer, Deputy Clerk <br />Jerry Carle, Applicant <br />Page 12 <br />
