NXC <br />MEMORANDUM <br />NORTHWEST ASSOCIATED CONSULTANTS <br />COMMUNITY PLANNING - DESIGN - MARKET RESEARCH <br />TO: Little Canada Planning Commission <br />FROM: Stephen Grittman <br />DATE: January 11, 1999 <br />RE: Little Canada - Setback Definition <br />FILE NO: 758.10 - 99.02 <br />In response to a building permit application last fall, staff discovered that the definition of <br />setbacks in the Zoning Ordinance allowed an unlimited encroachment as a part of a <br />cantilevered design. After discussion, the Planning Commission recommended an <br />amendment which would have limited any cantilevered building encroachment into the <br />required setback to a maximum of two feet. However, the City Council has returned the <br />issue to the Planning Commission for additional consideration. The Council's consensus <br />was that no encroachment should be allowed. The method to accomplish this is to amend <br />the definition of setback in the Zoning Ordinance. The change in the attached ordinance <br />language eliminates the current end phrase ( "at ground level "). Therefore, no <br />encroachment into the required setback area is permitted except by specific allowance. <br />Currently, the ordinance permits some encroachments for fireplace chimneys, eaves, <br />steps, ornamental features, and a few other similar building appurtenances.
