MINUTES CITY COUNCIL APRIL 27, 1999 VACATION OF UTILITY EASEMENT — PITRINA PARK SECOND ADD. The foregoing resolution was duly seconded by Pedersen. Ayes (5) Fahey, Pedersen, Morelan, LaValle, Scalze. Nays (0). Resolution declared adopted. Mrs. Scalze introduced the following resolution and moved its adoption: RESOLUTION NO. 99 -4-94 — INSTRUCTING THE CITY ADMINISTRATOR TO PROCEED WITH DISCUSSIONS WITH THE CITY OF VADNAIS HEIGHTS RELATIVE TO ANNEXING LOTS 2, 3, AND 4 TOTALLY WITHIN ONE CITY'S BOUNDARIES AND REQUESTING THAT THE ADMINISTRATOR COME BACK WITH SOME OPTIONS FOR THE COUNCIL'S REVIEW The foregoing resolution was duly seconded by LaValle. Ayes (5) Scalze, LaValle, Pedersen, Morelan, Fahey. Nays (0). Resolution declared adopted. Mayor Fahey opened the public hearing to consider the vacation of a utility easement over Lot 25, Block 1, Pitrina Park Second Addition. Council noted that the City Engineer has reviewed the vacation request and recommends approval. There was no one present from the general public wishing to comment on this matter. Upon motion by Morelan, seconded by LaValle, the public hearing was closed. Morelan pointed out that at one point there is 7.4 feet of easement on one side of the sewer easement. Morelan asked if this would be enough room should repairs ever be needed indicating that he thought 10 feet on either side of a pipe was the minimum that the City ever got. The City Administrator replied that the City Engineer has reviewed the vacation request. However, indicated that he would verify this with the Engineer. Mrs. Scalze introduced the following resolution and moved its adoption: RESOLUTION NO. 99 -4 -95 — VACATING THE WEST 8 FEET OF THE EAST II FEET OF LOT 25, BLOCK 1, PITRINA PARK TERRACE SECOND ADDITION AS REQUESTED BY FRANK FRATTALONE BASED ON THE RECOMMENDATION OF THE CITY ENGINEER AND SUBJECT TO HIS CONFIRMATION THAT Page 103
