MINUTES <br />PLANNING COMMISSION <br />MARCH 11, 1999 <br />for the City's feelings on the cul -de -sac being developed as a private <br />street. Keis asked for the Public Works Department's feeling on the <br />public street/private street issue. Keis understood that the private street <br />would be maintained by a homeowner's association consisting of the <br />property owners along the street. However, Keis questioned what would <br />happen to the street if the homeowner's association ceased to exist. <br />The City Planner suggested that a development contract would need to <br />address issues such as access to the street, the viability of the <br />homeowner's association on a Tong -term basis, etc. <br />Carson suggested that the street would have to be constructed to City <br />standards. <br />Knudsen asked the reason the developer would want the street to be <br />private. LaTendre suggested that the lots would be exclusive, and the <br />property owners would want to restrict access to the area and maintain this <br />area as being exclusive. LaTendre did not feel there would be a problem <br />with constructing the street to City standards. <br />Keis stated that he would like to know the pros and cons of public versus <br />private street. <br />The City Planner suggested that streets are usually allowed to be <br />constructed as private if there are some unique circumstances present that <br />would justify it. An upper -scale development, with a monument -type, <br />private entrance may be enough justification. <br />Knudsen pointed out that the Planning Commission will not be able to <br />deal with the issue of water main. <br />Keis pointed out previous discussion of the development of this area <br />which called for a walking path along the adjacent wetland. Keis asked if <br />the development of a walking trail along the lots would be conducive to <br />the private development that is being discussed. <br />LaTendre asked if there was still interest in the walking path, and agreed <br />that the property owner may feel differently about having a private <br />development if there will be a public walking path along the proposed lots. <br />Keis suggested that LaTendre approach the Parks & Recreation <br />Commission to see how they feel about the issue. <br />Page 19 <br />
