The aggregate materials stockpiling and /or recycling operation must <br />be the exclusive use of the property subject to the permit, and <br />shall not be mixed with other land uses, whether permitted or <br />conditional. <br />g. <br />The applicant /operator of the facility posts a financial security <br />guaranteeing compliance with the conditions listed in the permit <br />approval. <br />h. The applicant /operator of the facility executes an interim use <br />development agreement specifying the conditions of approval, the <br />amount and form of the security to be posted, and the termination <br />date of the interim use. <br />The existing recycling facility appears to meet the conditions laid out in the Ordinance <br />amendment. Staff is currently reviewing a proposed development agreement which will <br />detail the termination date and the amount of any financial security necessary to guarantee <br />compliance. As a separate consideration, the applicant may also be required to pay a <br />licensing fee which will be established by City Council action. <br />As a final note, the City's Code Enforcement Officer has a number of site development <br />issues which should be built into theā¢IUP. These will be made available to the Planning <br />Commission at its meeting on May 13.
