MINUTES <br />PLANNING COMMISSION <br />MAY 13, 1999 <br />higher than four feet. It was suggested that Frattalone discuss berm height <br />with the Council. <br />The City Planner suggested that the Council may want to amend the <br />section of the I -2 District that limits berm height to four feet. Given this is <br />a Zoning Code amendment, a public hearing would have to be held. <br />Mr. Keis recommended approval of the Interim Use Permit for aggregate <br />materials stockpiling and recycling for Fra -Dor located at 3137 Country <br />Drive subject to compliance with the recommendations of the Zoning <br />Administrator. <br />Motion seconded by Montour. <br />Motion carried 7 — 0. <br />REAR YARD Mr. Rick Thul, 165 East Viking Drive, appeared before the Commission <br />SETBACK - requesting approval of a variance to the required rear yard setback of 30 <br />VARIANCE feet. Thul pointed out that he has existing garage space at the rear of his <br />165 VIKING property which is setback approximately 26 feet from the rear property <br />DRIVE — THUL line. Thul stated that he would like to add garage space to his house, and <br />convert this existing garage space into living quarters. <br />It was pointed out that there are different rear yard setbacks for garage <br />space versus living space. A 30 -foot setback would apply for living space, <br />therefore, the setback variance is necessary in order for Thul to covert the <br />garage space to living space. <br />Knudsen asked what hardship is present to justify the variance pointing <br />out that this setback cannot be economic in nature. <br />Thul reported that a security concern is the reason he would like garage <br />space attached to his house rather than continuing to have the detached <br />garage space at the back of his property. Thul reported that there have <br />been two instances of graffiti being painted on the back of his garage. <br />Thul felt the improvements he would be making to his property would <br />improve property values in the area and generate more tax dollars for the <br />City. <br />Thul further indicated that he discussed his plans with the Building <br />Official and the City Planner about a year ago, and was not aware at that <br />time that the setback would be an issue. Thul reported that he has begun <br />construction on the garage addition to his house that was stopped because <br />Page 66 <br />
