Budka
Sweeney, Borer & Sweeney
Professional Association
Attorneys at Law
Suite 1200
386 North Wabasha Street
St. Paul, Minnesota 55102
June 2, 1999
VIA FACSIMILE AND U.S. MAIL
Mr. Joel R. Hanson
City Administrator
515 Little Canada Road
Little Canada, MN 55117
RE: Amendment of Frattalone
Development Contract (Fourth Amendment)
Our File No. 6748
Dear Joel:
Telephone
(651) 222 -2541
Facsimile
(651) 223-5289
Pursuant to our recent telephone conversations, please find
enclosed a proposed draft of the Fourth Amendment to the
Development Contract of October 1, 1990. In this regard, please
find enclosed copies of the documents previously drafted and
executed relative to this matter, which should be considered in
conjunction with the proposed Fourth Amendment.
The first document is the Development Agreement, dated
October 1, 1990. The second enclosed document is a Development
Contract Amendment, which appears to have been executed in July
and August of 1992. The next document is described as a proposed
Second Amendment, which was considered by the City Council in the
early summer of 1993. I believe there may have been a Third
Amendment relating to the stockpiling of dirt on the property,
which I do not have an executed copy of and therefore that Third
Amendment is not enclosed.
The proposed Fourth Amendment changes the existing
Development Contract in the following respects:
1. Restates the fact that the Developer is both a
corporation and an individual;
RECENEO J ; 0 4 1999
Page 3
