MINUTES <br />PLANNING COMMISSION <br />JUNE 9, 1999 <br />PRELIMINARY <br />PLAT — <br />R.J. MARCO <br />CONSTRUCTION <br />The Administrator pointed out that the front yard setback proposed by Mr. <br />Biagini would line the buildings up with the Kandice Heights buildings <br />and is not the setback recommended by the City Planner. The Planner <br />indicated that he had no problem with the setback Biagini is proposing <br />given the amount of right -of -way which exists for Country Drive. <br />However, if the City deviates from the Code requirements, there should be <br />a finding stated as to the reason why. <br />Biagini reported that the setback he is proposing is about 7 feet short of <br />the 40 feet that the City Planner is recommending. Even so, the building <br />will be setback about 62 to 63 feet from the curb line for Country Drive. <br />Biagini reported that this setback would line his building up with the <br />Kandice Heights buildings. <br />Mr. Montour recommended approval of the Biagini Preliminary Plat and <br />PUD Permit for Phase A subject to compliance with the recommendations <br />of the City Planner and the City Engineer, subject to a front yard setback <br />for the building to line it up with the Kandice Heights buildings with the <br />deviation in setback requirements because of the oversized right -of -way <br />which exists for Country Drive and because of the way Country Drive <br />curves in this area, subject to execution of a Development Agreement, that <br />there be no outdoor storage other than trash enclosures, and a wood fence <br />will not be allowed to screen from the residential property to the west, and <br />that all lighting and signage are in compliance with the Code. <br />Motion seconded by Knudsen. <br />Motion carried 5 — 0. <br />Mr. Reg Plowman, R. J. Marco Construction, and Mike St. Martin, <br />Loucks & Associates, appeared before the Commission requesting <br />approval of a preliminary plat for property along Viking Drive. Plowman <br />indicated that they are proposing to construct an office/warehouse building <br />on the site. <br />St. Martin indicated that he would address the issues raised by the City <br />Engineer. St. Martin described the location of the property. He noted that <br />in addition to the plat, they would be requesting a vacation of a portion of <br />the Viking Drive right -of -way which the State recently turned over to the <br />City. This will straighten their property line and allow them to bring <br />parking up to match the property line. It will also be necessary to vacate a <br />drainage and utility easement which runs through the center of the <br />property. That easement will be relocated to the east side of the property. <br />PAGE 150 <br />
